Information About Us www.fastpassdrivingschoolburton.co.uk is a site operated by Fast Pass Driving School, the trading name of Omar Yusean of 9 Colwyn Avenue, Littleover, Derby, DE23 6HH.
At Fast Pass Driving School our driving instructors are all self-employed franchisees, therefore we act as their agent, taking bookings and transferring payments across to them. The contract for driving lessons is between pupils and their instructors.
Once you have made a payment to us, we will forward the total amount to the driving instructor, after the first lesson has been conducted. In the event you would like a refund, please approach your instructor first. If you are unhappy with this, we recommend that you pay your instructor for each individual lesson, though you will not be able to take advantage of a block booking discount if you choose to pay per lesson.
For your financial peace of mind and protection, we strongly advise any block payments should be made to Fast Pass Driving School over the phone or online. We cannot be held responsible for any large sum cash payments you decide to give to your instructor on your lessons.
Fast Pass Driving School instructors will provide the pupil with a dual controlled car in a clean and roadworthy condition.
All Fast Pass Driving School instructors will represent themselves in a professional manner and be smart in appearance.
Fast Pass Driving School has a strict no smoking policy.
Fast Pass Driving School driving instructors will abide by an equal opportunity policy and will not discriminate against race, colour, creed, gender or sexual orientation etc.
Payments made to your Instructor
Any block bookings paid to the instructor direct by cash or bank transfer is solely between the pupil and the franchised instructor. In the unlikely event you are unhappy or need help resolving an issue, you can contact the office and we will try to help resolve the situation.
Like any type of cash purchase; be it from a shop or your driving instructor, you are entitled to ask for a receipt. Please ensure you ask for a receipt on the day of paying cash to the instructor. You must inform us immediately after the lesson if you haven’t obtained a receipt and you would like one.
We cannot be held accountable for any cash/bank transfer payments made to your Fast Pass Driving School instructor. The safest and most secure way to protect your money is by paying Fast Pass Driving School by debit/credit card or bank transfer.
If you are experiencing difficulty with a cash/bank transfer refund from your instructor, Fast Pass Driving School will try to assist on your behalf.
If you have paid Fast Pass Driving School, your money is protected and you will receive a refund/part refund depending on the complaint and how many hours are still outstanding.
Offers and Price Changes
Fast Pass Driving School are entitled to change driving tuition offers and prices at any time. Lesson prices are subject to change depending on location and whether you learn in an automatic or manual vehicle.
Any pre-payments are honoured at the time in which they were purchased, but the first lesson must be taken within a 6-month period from the date of purchase.
4 lessons for £50 offer
The 4 lessons for £50 offer is only available to those who have no driving experience and/or do not hold a motorcycle licence. To go ahead with the offer, an upfront payment of £50 needs to be made before any driving lessons can be taken.
The 4 lessons are split into 1×2 hour lesson at the beginning, with the final 1×2 hour lesson taken on the last week of your driving test. The final 2-hour lesson is conditional upon taking regular driving lessons with a minimum of 36 hours in between the first 2-hour session and the last. All driving lessons taken in between the first and last session will be charged in accordance to the pricing structure at that time.
If there is a break of more than 14 days between any of the driving lessons, the 2 remaining hours will be forfeited. If you decide not to carry on with Fast Pass Driving School for any reason, you will not be refunded for the remaining 2 hours.
If you wish to cancel/rearrange a driving lesson, then a minimum of 48 hours’ notice must be given. This should be made directly with your driving instructor.
If you decide to go ahead with this offer, then it cannot be used in conjunction with any other offers we may have.
Driving Test Policy
In the event of you having your practical driving test, the DVSA requires three working days to cancel your test. You are allowed to take your driving test if the driving instructor feels that you are ready for your test. If the instructor feels you are not ready for your test, they will inform you in time for you to change your test. If you decide not to, the driving instructor can withdraw their car for the use of the test. This is at the driving instructor’s discretion.
If your driving instructor is unable to take you on your driving test due to illness or bereavement, we will attempt to find you a replacement driving instructor but this is not guaranteed. If the driving instructor is unable to take you to the test due to a mechanical fault with the vehicle, we will attempt to find you a replacement driving instructor and vehicle but we cannot guarantee an identical vehicle.
If you attend your test and the driving examiner has deemed the driving instructor’s vehicle not roadworthy for any reason, your driving instructor will pay for your replacement test.
In the event that the vehicle is damaged by you (the pupil) during the driving test, you will be required to pay the total repair cost.
You will be charged for the hour of your driving test at the normal lesson rate, unless stated otherwise.
Fast Pass Driving School requires a minimum of 24 hours notice if you wish to cancel/rearrange your driving lesson. This must be made directly with your driving instructor. If you are unable to get in contact with your driving instructor, then you must let the office know within the required timeframe. If you give notice less than 24
hours, your instructor is entitled to charge you the normal rate for the driving lesson that you have cancelled/rearranged, or the prorated rate if it is a block booking.
If you have booked an intensive course (20-45 hours) with Fast Pass, we require a minimum of 2 weeks notice if you would like to cancel. If you have booked a course which is less than 20 hours, we require a weeks notice for any cancellations. Failure to do so, means you will lose your deposit. If you decide to cancel part way through your intensive course, you will not be refunded for the remaining hours of the course.
On your first driving lesson, you will be required to present a valid UK provisional driving licence. Failure to do so entitles the instructor to cancel the driving lesson and you may be charged. Any lessons that you have booked will be cancelled until you are able to provide us with the provisional licence.
If the instructor wants to cancel a lesson, this should be given within a minimum of 24 hour’s notice. If the instructor cancels the lesson without giving this, they will rearrange the lesson.
Fast Pass Driving School cannot be responsible for any lesson/test cancellation due to mechanical breakdown or other emergencies such as an illness or bereavement. We will attempt to find a replacement vehicle/driving instructor as soon as possible but this is not guaranteed.
Refund and Complaints Policy
You can cancel your pre-paid driving lessons at any time (subject to the cancellation policy). If you haven’t taken any of these driving lessons at the time of cancellation, you will be entitled to a full refund. Where possible, we will refund you using the same method of payment you used to pay for your lessons. If not, we will refund you by any other method that we deem appropriate. To receive a refund, you should contact us within 30 days of making the purchase. Any refunds can take up to 10 working days to reach you or your account.
In the event of block bookings, the refund will be made pro-rata on any lessons that have not been taken. All pre-paid block lessons are only valid for 6 months, so any lessons remaining after this timeframe will not be refunded.
If you book an intensive driving course with Fast Pass Driving School and you choose not to commence any lessons, you will lose your deposit unless given the appropriate notice (2 weeks). If you have commenced an intensive course and you choose not to carry on, you will not be refunded for any remaining hours.
If you have paid your driving instructor directly and you would like to cancel, the instructor will refund you using the same policy above.
Your contract is between you and your driving instructor. In the event of any problem arising, you should first try and resolve this with your instructor. We recommend that you do not take any further driving lessons with your instructor until the matter is resolved. In the unlikely event that the matter cannot be resolved directly with your instructor, then please inform us via email to firstname.lastname@example.org To ensure your complaint is dealt with as quickly as possible, please include your driving instructors name, lesson times, the reasons why you are making a complaint as well as a contact number for yourself. Our office manager will aim to respond to your query within five working days.
Use of Personal Information
Fast Pass Driving School and/ or your instructor are not liable to you for any loss or damage caused where, and to the extent that:
· There is no breach of a legal duty owed to you by the relevant person or body;
· Such loss or damage is not a reasonably foreseeable result of such a breach of legal duty;
· Any such loss or damage, or increase in the same, results from any breach or omission by you; or
· Any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body.
Fast Pass Driving School and/ or your instructor shall not, in any event, be liable for losses relating to any business interests you may have including, without limitation, lost profits, loss of opportunity or business or business interruption.
Nothing in these Terms and Conditions will affect any statutory rights you may have as a consumer.
Your instructor will have the appropriate motor insurance to provide comprehension cover should you be involved in a collision as a learner driver, whilst in control of driving the instructor’s vehicle.
Mechanical physical damage to car within lesson
In the event that the teaching vehicle has a mechanical fault during the lesson, which could not be prevented, our instructor will pass the remaining time left onto your next lesson. If this is not possible, or instructor will offer a refund for the remaining minutes owed.
In the event that the car is damaged due to driver error from the pupil, any time spent resolving the issue will count as the pupil’s lesson time.
For example: if the pupil hits the kerb on a road and damages the alloy/punctures a tyre, the pupil will lose any remaining minutes it takes to change the tyre. The instructor will not charge the pupil for the damages – only lesson time may be lost
